Affirmative Action Plans
For banks with 50 or more employees, including bank holding companies, an Affirmative Action Plan is required under Executive Order 11246. We thoroughly review client-provided data to ensure its accuracy and to ensure it is displayed in as positive a light as possible. We also ensure the client understands the potential issues we believe a federal auditor would find during a compliance review and offer suggestions for resolving those issues. These processes are done for affirmative action plans covering minorities, women, disabled individuals, and covered veterans. We will develop a compliant OFCCP affirmative action plan specifically developed for your bank. We will represent you in case of an OFCCP audit to insure OFCCP understands the nature of your plan and how it is managed. Our plans have passed the OFCCP audit requirements.
Our AAP preparation also includes compiling and submitting the EEO-1 and Vets-100 reports due September 30 of every year. There is no extra cost for this.
EEOC/Wage and Hours Claim Resolution/ Investigation:
It is often helpful to retain an independent person to investigate an internal employee complaint or to investigate a discrimination charge filed with EEOC or a State Human Rights Agency or Department of Labor for wage complaints. This sends a message to your employees of the importance the bank puts on their complaint and will often be more agreeable to informally resolving the issue. In addition, we can often provide assistance in resolving the issue or in assisting the bank in defending its position, should that need arise. We will investigate and respond to all EEOC charges and Wage Hour complaints you may receive. We have handled over 150 EEOC charges and numerous Wage and Hour investigations successfully.
Fair Labor Standards Act (FLSA) There has been a large degree of confusion surrounding regulations affecting exemption status. Several banks have been the target of Wage and Hour investigations leading to hefty fines for inappropriate job classifications and overtime payment.
